In compliance with Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market For Digital Services (Digital Services Act – DSA), the Braga Business Association (AEB), as the managing entity of the platform www.e-povoamarket.com, adopts this set of rules and procedures aimed at ensuring:

• responsible content moderation;
• combat against the dissemination of illegal content;
• protection of platform users;
• transparency in the use of advertising and recommendation systems.

 

1. What is the DSA?

The Digital Services Act (DSA) is a European Union legislative instrument that establishes obligations for digital platforms with the aim of strengthening safety, transparency, and fundamental rights in the European digital space.
Among the main objectives of the DSA are:

• Creation of effective mechanisms for reporting illegal content;
• Strengthened protection against online harassment and intimidation;
• Prohibition of targeted advertising based on sensitive data or targeting minors;
• Guarantee of transparency in recommendation systems and the presentation of advertisements;
• Implementation of accessible, effective, and free complaint channels.

 

2. Applicability to Marketplace Customers

The DSA applies to all intermediary platforms established in or targeting the European Union. If you use the Marketplace www.e-povoamarket.com as a Customer, the provisions of the DSA apply to you, granting you additional rights regarding safety, transparency, and data protection.

3. How the Centro Braga Marketplace Ensures DSA Compliance

The AEB guarantees the implementation of the following measures:

• Mechanisms for notification and removal of illegal content;
• Active monitoring and moderation of content, in accordance with legal requirements;
• Transparency in terms of use and product presentation;
• Clear identification of advertising content (“Sponsored”);
• Prohibition of advertising based on sensitive data or relating to minors;

 

4. Illegal Content

Illegal content includes any information, goods, or services made available on the platform that contravene national or European legislation, including:

• Incitements to violence or hatred;
• Sale of illegal products;
• Copyright infringements;
• Dissemination of disinformation harmful to public health or safety.

 

5. Content Moderation

The AEB reserves the right, in a diligent and proportionate manner, to remove, hide, or restrict access to illegal content or content that contravenes the Marketplace’s Terms of Use and General Sales Conditions, as well as to suspend or delete accounts in case of repeated infringements.

6. Reporting Illegal Content

Customers or any user may report potentially illegal or inappropriate content through the form. The AEB undertakes to review all reports and, where appropriate, take action in accordance with the defined procedures.

7. Dark Patterns

The Centro Braga Marketplace does not use design practices that induce the Customer to make decisions without clear information or that distort their will. All navigation, consent, and contracting options are presented in a transparent and understandable manner.

8. Advertising

All advertising on the Marketplace is clearly identified with the label “Sponsored”. Displayed ads are based exclusively on objective criteria such as search history, product popularity, and commercial relevance.

9. Recommendation Systems

The Marketplace uses automated systems to rank and recommend products based on visible criteria, such as:

• Relevance;
• Price (ascending or descending);
• Rating;
• Discount;
• Paid promotion.
